Evidentiary Considerations

There is no hard and fast rule on admissibility, and the court has significant discretion in determining whether digital records may be admitted in civil or criminal proceedings. The following is a summary of the general conditions that apply under the Evidence Act, Chap. 7:02 of Trinidad and Tobago.

Computer-Generated Records

A computer-generated record may be admitted where the system was used regularly in the ordinary course of business, the computer was operating properly, and the information derives from entries made in the ordinary course of business. Audit trails and witness testimony are critical to establishing authenticity and reliability.

Multimedia Evidence

Photographic, video, and audio recordings may be admitted where authenticity, non-alteration, and a clear chain of custody can be demonstrated. The party tendering the evidence must establish who made the entry, when and how it was made, and that it is a true and accurate record.

Note on Private Security Personnel: Police Standing Orders are authoritative and procedurally binding on police officers because they are made pursuant to the Police Service Act. There is no equivalent legislation governing private industry. Private security personnel are treated as private individuals in court proceedings and are not in a position to benefit from any credibility or reliability considerations that may be afforded to police officers in the exercise of their duties. This makes the technical integrity of the record system particularly relevant for private security firms.

Developer-Facing Compliance Specification

The system architecture was built to a compliance specification prepared by legal counsel. The specification addresses six technical areas relevant to producing records that may support admissibility requirements.

Comprehensive, immutable logs recording every access, viewing, and export action performed in the system.
